De gedragsbeïnvloedende en vrijheidsbeperkende maatregel in 2022

Abstract

Dit rapport beschrijft de kenmerken van de gedragsbeïnvloedende en vrijheidsbeperkende maatregelen (GVM’s) in 2018 tot en met 2022. De GVM is een van de drie onderdelen van de Wlt en geldt vanaf 1 januari 2018. Met deze zelfstandige toezichtmaatregel kan toezicht worden gehouden na afloop van een gevangenisstraf en/of tbs-maatregel. De onderzoeksvragen gaan over het aantal opleggingen, kenmerken van de opleggingen, adviezen van de reclassering en het Nederlands Instituut voor Forensische Psychiatrie en Psychologie (NIFP) en de argumentatie van de rechtbanken en hoven. Ook zijn kenmerken vastgelegd van uitspraken over de tenuitvoerlegging van de GVM, en over één verlenging van een GVM.

The aim of the current report is to describe all court rulings on either the imposition or execution of the MBI from 2018 through 2022. The Measure on Behavioural Influence and Limitation of Freedom (MBI; in Dutch: Gedragsbeïnvloedende en Vrijheidsbeperkende maatregel or GVM), which came into effect on 1 January 2018, is one of the three parts of the LTSA. The research questions focus on the amount of MBI impositions and their characteristics; recommendations about the necessity of the MBI issued by the Probation Services and the Netherlands Institute for Forensic Psychiatry and Psychology (Nederlands Instituut voor Forensische psychiatrie en psychologie; NIFP); and the reasoning of primary, appeal and higher appeal courts when imposing or ordering to execute the MBI.
