Een verkennend onderzoek naar uitsluiting van ex-leden door religieuze gemeenschappen

Abstract

Het onderzoek kent een sociaalwetenschappelijk aspect – onderzoek naar het fenomeen uitsluiting door religieuze gemeenschappen, en een juridisch aspect – verkenning van (buitenlandse) wet- en regelgeving om uitsluiting te voorkomen of anderszins ermee om te gaan. Het doel van het onderzoek is: Zicht krijgen op het fenomeen 'uitsluiting' Zicht krijgen op maatregelen tegen uitsluiting door religieuze gemeenschappen in Nederland en in andere landen Het is hierbij van belang om zicht te krijgen op het uitsluitbeleid van religieuze gemeenschappen in het algemeen en niet van specifieke religieuze gemeenschappen. Deze hoofdvragen zijn geformuleerd: Bestaat sociale uitsluiting van ex-leden van religieuze gemeenschappen? Zo ja, welke vormen van uitsluiting zijn er en hoe worden deze geformaliseerd en in de praktijk uitgevoerd? Welke gevolgen heeft uitsluiting voor diegenen die uitsluiten en diegenen die uitgesloten worden? Welke hulpbehoefte is er vanuit beide groepen? Welke (juridische) mogelijkheden zijn er in Nederland om met uitsluiting om te gaan dan wel uitsluiting te voorkomen? This report constitutes the outcome of a legal and socio-scientific study into the exclusion of former members by religious communities. The report presents the results of a desk study, an empirical study (interviews) and a thematic legal comparison. In general, two aspects are examined in the report: a social science aspect – an analysis of the phenomenon of exclusion by religious communities, and a legal aspect – an exploration of (foreign) measures to prevent or otherwise deal with exclusion. An important goal of the report was to provide insight into exclusion policies of religious communities in general, rather than focusing on specific religious communities. To achieve the objectives of the research, two main questions were formulated, focusing on the forms and measures related to exclusion. The primary questions are as follows: Forms of social exclusion Does social exclusion of former members of religious communities exist? If so, what forms of exclusion exist, and how are they formalised and implemented in practice? What are the consequences of exclusion for both those who exclude and those who are excluded? What needs for support exist from both groups? Measures against exclusion What (legal) possibilities exist in the Netherlands to deal with exclusion or to prevent exclusion? What measures are taken in other countries to deal with the exclusion of former members or to prevent exclusion?
