Kansen en risico's van de toepassing van neurotechnologie in het strafrecht

Abstract

De laatste jaren is er veel aandacht voor neurotechnologie. Het gaat hierbij om technieken die bijdragen aan kennis over de hersenen en/of die interacteren met de hersenen. De aandacht voor neurotechnologie wordt onder andere veroorzaakt door de voortdurende technologische vooruitgang. Omdat neurotechnologie (ook) potentie heeft voor toepassing binnen het justitie- en veiligheidsdomein heeft het Wetenschappelijk Onderzoek- en Documentatiecentrum (WODC) van het ministerie van Justitie en Veiligheid opdracht gegeven om onderzoek te doen naar de kansen en risico’s van dergelijke toepassing van neurotechnologie. Dit rapport is het resultaat van dat onderzoek. In dit rapport staat de volgende onderzoeksvraag centraal: ‘Welke kansen en bedreigingen kunnen worden verwacht van neurotechnologie voor het domein van ministerie van Justitie en Veiligheid en welke impact (juridisch, ethisch en maatschappelijk) kan neurotechnologie hebben voor beleid?’ INHOUD: 1. In recent years, neurotechnology has received significant attention. Neurotechnology concerns techniques that contribute to knowledge about the brain and/or that interact with the brain. The attention for these techniques partly results from continuous technological progress. Because neurotechnology (also) has relevance for application within the justice and security domain, the Scientific Research and Documentation Center (WODC) of the Ministry of Justice and Security has commissioned research into the opportunities and risks of such application of neurotechnology. This report is the result of that research. This report focuses on the following research question: 'What opportunities and threats can be expected from neurotechnology for the domain of the Ministry of Justice and Security and what impact (legal, ethical and social) can neurotechnology have for policy?'
