dc.description.abstractThe entry into force of the Court Bailiffs Act (Gdw) in 2001 reshaped the profession of the court bailiff. Court bailiffs have a special position in the Dutch legal system. As public officials, they are authorised to carry out tasks entrusted to them under the Gdw whilst simultaneously being commercial operators. The Gdw introduced a system of free establishment to replace the previous system in which establishment was restricted and there was a national authority for court bailiffs. These changes were designed to introduce more competition into the sys-tem. The legislator also chose to rename the Royal Association of Bailiffs (KVG) as the Royal Professional Association of Bailiffs (KBvG). The task of the KBvG is laid down by law in Article 57 of the Gdw, which stipulates that the KBvG must support good professional practice and professionalism among its members. To this end, this organisation has been given the form of a Professional Organisation under Public Law (PBO), with the power to issue regulations. The study was carried out with reference to three themes: a policy reconstruction, describing the establishment of the KBvG as a PBO and the policy theory underlying it; the functioning of the KBvG in practice; and the efficiency and effectiveness of the KBvG.
dc.description.abstractMet de inwerkingtreding van de Gerechtsdeurwaarderswet (Gdw) in 2001 is het beroep van de gerechtsdeurwaarder opnieuw vorm gegeven. Gerechtsdeurwaarders hebben een bijzondere positie in het Nederlandse rechtsbestel. Zij zijn als openbaar ambtenaar bevoegd taken uit te voeren die op grond van de Gdw aan hen zijn opgedragen en zijn tegelijkertijd ondernemer. De Gdw introduceerde een stelsel van vrije vestiging in plaats van het toenmalige standplaatsenstelsel en van een landelijke bevoegdheid voor gerechtsdeurwaarders. Deze wijzigingen beoogden meer marktwerking in het stelsel te introduceren. Tegelijkertijd koos de wetgever ervoor de Koninklijke Vereniging voor Gerechtsdeurwaarders (KVG) om te zetten in de Koninklijke Beroepsorganisatie van Gerechtsdeurwaarders (KBvG). De taak van de KBvG is wettelijk vastgelegd in artikel 57 Gdw dat bepaalt dat de KBvG een goede beroepsuitoefening door de leden en hun vakbekwaamheid dient te bevorderen. Daartoe heeft deze organisatie de vorm van een Publiekrechtelijke Beroepsorganisatie (PBO) gekregen, met daarbij een verordenende bevoegdheid. Het onderzoek is uitgevoerd aan de hand van drie thema’s: een beleidsreconstructie, waarin de totstandkoming van de KBvG als PBO en de beleidstheorie die daaraan ten grondslag ligt is beschreven, het functioneren van de KBvG in de praktijk en de doelmatigheid en doeltreffendheid van de KBvG.
