dc.description.abstractThe aim of this research is to gain a better insight into the nature and size of the group of habitual offenders in bankruptcy fraud and their modus operandi. This study also attempts to provide insight into how habitual offenders of bankruptcy fraud are handled by the various actors and how this approach can be improved. Particular attention is paid to the possibilities and impossibilities of proactively identifying and following individual habitual offenders within the framework of the rule of law. To this end, the following two main questions are central: (i) to what extent are there possibilities to detect professional fraudsters or habitual offenders in bankruptcy fraud and to identify the risk of recidivism at an early stage?, and (ii) how can the current approach to habitual offenders of bankruptcy fraud be improved in terms of detection, intervention, cooperation, information exchange and legislation?
dc.description.abstractOm beter inzicht te verkrijgen in de aard en omvang van de groep van veelplegers in de faillissementsfraude en hun modus operandi, is onderzoek uitgevoerd naar deze groep. Tevens heeft deze studie tot doel om inzichtelijk te maken op welke wijze veelplegers van faillissementsfraude momenteel door de verschillende actoren betrokken in de aanpak worden bestreden en hoe die aanpak kan worden verbeterd. Hierbij wordt met name aandacht besteed aan de (on)mogelijkheden van proactief signaleren en volgen van individuele veelplegers binnen de kaders van de rechtstaat. Hiertoe staan de volgende twee hoofdvragen centraal: Hoofdvraag 1 : In hoeverre zijn er mogelijkheden om beroepsfraudeurs c.q. veelplegers in de faillissementsfraude te detecteren en het risico op recidive vroegtijdig te kunnen signaleren? Hoofdvraag 2: Hoe kan de huidige aanpak van veelplegers van faillissementsfraude worden verbeterd als het gaat om detectie, interventies, samenwerking, informatiedeling en wetgeving? INHOUD: 1.
