Abstract

Through technological developments, legal systems increasingly apply videoconference in their criminal proceedings. Videoconference enables a direct video and audio connection between those involved in criminal proceedings. With the improvement of videoconference technology, it is more and more considered as a reasonable alternative to physical appearance. The application of videoconference had in recent years already increased. The global COVID-19 pandemic prompted a heightened focus in the Netherlands as well as everywhere else in the world on the potential to hold criminal proceedings despite having to limit physical contact through the use of videoconference. This generated a need for further research for particularly its application for the accused, considering the implications for guaranteeing the rights of the accused and fundamental principles like immediacy and the public nature of a trial. The main question of this research is: “What can the Netherlands learn from national and international standards and practice of the use of videoconference for the accused with a view to its standardization and policy development in Dutch criminal legal practice?”National and international standards and practice have been mapped out by researching the regulations and practices of the Netherlands, Italy, France, Canada, Switzerland, Germany and international and transnational criminal law.

In toenemende mate wordt gezocht naar toepassing van digitale methoden in het strafproces. Door technische ontwikkelingen zijn de mogelijkheden voor toepassing van videoconferentie in het strafproces gegroeid. Met de verbetering van techniek, wordt videoconferentie, waarbij een directe beeld- en geluidsverbinding tot stand wordt gebracht tussen de betrokken personen in het strafproces, steeds meer als redelijk alternatief beschouwd voor fysieke aanwezigheid.Op dit moment bestaat onvoldoende duidelijkheid over de vraag in hoeverre videoconferentie ook kan worden toegepast bij de verdachte en aan welke eisen en waarborgen toepassing ten aanzien van de verdachte moet voldoen. Net als in andere landen is ook in Nederland dit thema in beweging en is er behoefte aan nader inzicht in de nationale en internationale normering en praktijk voor de verdere ontwikkeling in de Nederlandse strafrechtpraktijk. De hoofdvraag van dit onderzoek luidt daarom: “Wat kan Nederland uit de nationale en internationale normering en praktijk van de toepassing van videoconferentie bij verdachten leren met het oog op de normering en beleidsontwikkeling ervan in de Nederlandse strafrechtpraktijk?” De nationale en internationale normering en praktijk is in kaart gebracht door onderzoek te doen naar de regelingen en praktijk van Nederland, Italië, Frankrijk, Canada, Zwitserland, Duitsland en het internationale en transnationale strafrecht.
