Abstract

The legal profession fulfils an important and special role and position in the constitutional state. The Dutch Act on Advocates (Advocatenwet, AW) guarantees the special position of the lawyer. Various recommendations and research reports at the end of the last and the start of this century showed that supervision was insufficient and needed modernization and improvement, partly due to the growth of the legal profession and the increasing internationalization in recent decades. After a complex legislative process, this finding ultimately led to the Act of 1 October 2014 amending the Act on Advocates, and some other laws relating to the position of the legal profession in the legal order and reviewing the supervision of the legal profession (Act on the position and supervision of the legal profession (Wet positie en toezicht advocatuur, Wpta)), which amended the Act on Advocates and some other laws as of 1 January 2015.The main research question is: Does the system of supervision introduced by the Act on the position and supervision of the legal profession function in accordance with its objectives, how do other legislative amendments, including the disciplinary rules, work and do they contribute to the quality of the legal profession?

De advocatuur vervult een belangrijke en bijzondere rol en positie in de rechtsstaat. In de Advocatenwet (Aw) is de bijzondere positie van de advocaat wettelijk geborgd. Uit verschillende adviezen en onderzoeksrapporten eind vorige en begin deze eeuw bleek dat het toezicht onvoldoende was en modernisering en verbetering behoefde, mede vanwege de groei van de advocatuur en de toenemende internationalisering in de afgelopen decennia. Deze constatering heeft uiteindelijk na een complex wetgevingsproces geleid tot de Wet van 1 oktober 2014 tot aanpassing van de Advocatenwet en enige andere wetten in verband met de positie van de advocatuur in de rechtsorde en herziening van het toezicht op advocaten (Wet positie en toezicht advocatuur, Wpta), waarmee per 1 januari 2015 de Aw en enige andere wetten zijn gewijzigd. De kern van de wetswijziging heeft betrekking op de herziening van het toezichtstelsel. De Wpta voorziet daarnaast in de codificatie van de kernwaarden als toetsingskader voor de beroepsuitoefening door advocaten, een beperkte aanpassing van het tuchtrecht en enkele andere wijzigingen. De hoofdvraag van het onderzoek luidt als volgt: Functioneert het door de Wet positie en toezicht advocatuur geïntroduceerde stelsel van toezicht overeenkomstig zijn doelstellingen, hoe werken de overige wetswijzigingen, waaronder het tuchtrecht, en leveren die een bijdrage aan de kwaliteit van de advocatuur?
