Behoeften inventarisatie voor de ontwikkeling van financieel rechercheren in de Europese Unie

Abstract

The central question of this study is to assess which tools would help law enforcement best in stepping up the use of financial investigations and cross-border cooperation in this field. Financial investigations are carried out within several contexts: criminal investigations (including conviction based asset confiscation), civil investigations (including non-conviction based asset confiscation), tax investigations, and social service investigations. This study focuses on financial investigations in the context of criminal investigations. De centrale vraag van het onderzoek luidt: In hoeverre is er behoefte bij de EU lidstaten aan nieuwe methodieken en de daarbij behorende tools van financieel rechercheren om hiermee de georganiseerde en ondermijnende criminaliteit tegen te gaan? Welke zijn de belangrijkste behoeften van de EU lidstaten op het gebied van financieel rechercheren? Deze studie richt zich op financieel rechercheren in de context van strafrechtelijke onderzoeken. Daarnaast vind er ook financieel onderzoek plaats in het kader van onder meer fiscale onderzoeken of onderzoeken ten behoeve van de sociale dienst. Dergelijke vormen van financieel onderzoek vallen buiten het kader van deze studie. De studie bouwt voort op onder meer: de bevindingen, conclusies en aanbevelingen van de ‘Fifth cycle of mutual evaluations on financial crime and financial investigation’, adopted by the Council on 26 October 2012 (doc. 14597/12), aanbevelingen van de Financial Action Task Force (FATF) ten aanzien van het financieel rechercheren, EU beleidsdocumenten en wetenschappelijk onderzoek.
