dc.description.abstractThe Equalisation of Pension Rights in the Event of a Divorce Act [Wet verevening pensioenrechten bij scheiding, WVPS] entered into force on 1 May 1995. The aim of the study is to examine whether current legislation in the case of divorce (in the WVPS, the Pensions and Savings Funds Act [Pensioen- en Spaarfondsenwet, PSW] and the Dutch Civil Code) is still effective. This relates to a commitment made by Parliament (Proceedings II, 5 April 2005, p. 68-4301, confirmed in a letter from the Minister of Social Affairs and Employment to the Lower House dated 30 June 2005). The statutory regulations were established before the surviving dependant’s pension under pension schemes was converted on a large scale from ‘accrual basis’ to ‘risk basis’.

In het onderzoek moet worden bezien of de huidige regelgeving bij echtscheiding (zowel in de WVPS, de PSW als in het BW) nog doeltreffend is. Het betreft hier een Kamertoezegging (Handelingen II, 5 april 2005, p. 68-4301, bevestigd in een brief van Minister SZW aan TK dd. 30 juni 2005). De wettelijke regelingen zijn tot stand gekomen voordat het nabestaandenpensioen in pensioenregelingen op grote schaal werd omgezet van opbouwbasis naar risicobasis. De vraag die in dit onderzoek beantwoordt wordt is of het doel van de wet bereikt is.
